Things to Watch Out For — Whether You’re the Plaintiff or Defendant

You’re the client. You’re the boss — not your attorney. Don’t let your attorney forget who works for who. Their job is to do what’s in your best interest, not what they decide is best for you.

Whether you’re the plaintiff or the defendant, take the time to fully understand exactly what your case is about. If you’re the plaintiff, know exactly what your case is truly worth and don’t settle for a penny less than what you’re owed. The more you understand your own case, the harder it is for your attorney or the other side to take advantage of you.

Your attorney should be updating you regularly on what’s happening with your case. If they only communicate with you when you have a court date or when they need something from you, that’s a major red flag. They should stay on top of your case at all times and come to every meeting or hearing fully prepared.

Make sure your attorney is actually working for you — not just going through the motions. Make sure your attorney talks to you before they make any offers, file any motions, or make any major decisions in your case. You should be part of every important decision, not just told about it afterwards.

Never sign any document, settlement, or agreement just because your attorney is pushing you to. If you don’t understand every single word, stop and get it explained until you do. If you don’t completely understand it, do not sign it. Period. Your signature is your responsibility, not your attorney’s.

Read every single page carefully. Make sure you fully understand exactly what you’re signing, what rights you’re giving up, what you’re gaining, and what you could be losing by signing it. I got screwed because I didn’t do this — don’t let it happen to you. Never let anyone rush you or pressure you into signing something you don’t understand.
